Please review the following terms and conditions relating to this reservation.

Agree to rent a unit from Island Winds Condominium Bath and Racquet Club, Inc. and have read, understand and agree to the following conditions, policies and terms:


Please understand, and tell everyone staying in your unit, that you are visiting someone's home.  Most of the residents staying here are owners.  They want everyone residing here to be respectful of their home - which includes all the common areas shared by everyone. We strive to maintain a family atmosphere for the quiet enjoyment of our guests. The Board of Directors and the Condo Association has mandated rules and regulations to ensure quality renters.


RESERVATIONS – Reservations may be made by phone or via internet, but must be confirmed in writing by Island Winds.  The person making the reservation must also be staying in the condo and be at least 25 years old.  The credit card address must match the address of the person making the reservation.  Island Winds will make every attempt to honor unit requests but reserves the right to offer a comparable unit in the event that unit is unavailable.  No more than six (6) individuals may stay in any unit unless the owner restricts occupancy.  If any unit exceeds the maximum number of people allowed in their lease, the entire party will be asked to check-out with no return of unused balances or security deposits.


AMENITIES - Island Winds will make every effort to have common area amenities (elevators, pool, spa, exercise room, etc.) available to you during your stay. However, we cannot guarantee the use of any or all facilities. As such, we will be unable to discount or refund any monies or deposits, or reduce the unit rate if they are out of operation at any time during your stay. Similarly, we cannot refund or compensate for appliance failure in your unit.


CONSTRUCTION MONTHS – The months of May through October are designated for any building and/or unit construction that needs to be done in our condos. Please be aware that if you are renting during these months, you may hear construction noise from outside the building between the hours of 8-5, and within the building within the hours of 9-5, Monday through Friday.  No refunds or discounts will be given.


RATES and PAYMENTS – Our rates are for 4 people with some units allowing 6 people for an additional $70 per person per week plus tax.  Rates are locked-in at 120 days.  A refundable $500 security deposit is due at time of reservation.  Fifty percent (50%) of the total rental amount, including all taxes and fees, is due upon reservation.  The remaining balance will be taken by the Island Winds office on your arrival date.  An accepted credit card (Visa, Mastercard or Discover) or cashier’s check for the exact amount due is the only form of payment that will be accepted.  Cash and personal checks will not be accepted. (Guests who transfer their security deposit to the same unit for the same dates the following year will be charged the 50% payment at 120 days before arrival, as a courtesy.)


CANCELLATIONS – The security deposit and all monies paid will be refunded, less a $100 administration charge, for cancellation of a reservation prior to 120 days from arrival date.  If a reservation is cancelled 120 days or less of the arrival date, the security deposit and all other monies paid toward the bill will NOT be refunded.  After check-in, any unused portion of reservation, due to termination or early departure for any reason, will not be refunded, except if the Town of Fort Myers Beach issues a mandatory hurricane evacuation order.  Under those circumstances, all renters must vacate the property and will receive a refund of the unused portion of their stay.


NOTE: Fort Myers Beach is a barrier island which experiences intense storms from time to time.  In the unlikely event storm damage occurs in your rental unit, or the property in general, during your stay, you will not be entitled to any compensation as a result of any weather event.  This includes any inconvenience during restoration.  The only exceptions to this policy are the provisions listed in the “mandatory evacuation policy” listed in this agreement.


SECURITY DEPOSIT - The security deposit will be held for up to 45 days after departure to ensure any damages and charges are accounted for.  Any damages identified to the unit or Island Winds property during reservation will be deducted from the security deposit.


CHECK-IN – Your keys, fobs and registration paperwork will be in the lockbox. Check-in is required upon arrival, or as soon as the office opens. Please leave your completed paperwork back in the lockbox and show your ID at THE EXTERIOR OFFICE door.  All individuals in a unit must be registered with full names.  All guests under 21 must have their ages listed on the check-in form.  Our cleaning service personnel has verified the condition and contents of your unit.  Upon arrival, immediately review the condo checklist on the kitchen counter and report any damages or missing items.  Damaged or missing contents not previously reported will be charged to the renter. 


POOL DECK – You agree to inform the residents and guests staying in your unit that ball playing is not allowed in the pool or on the pool deck.  Throwing and catching balls across the pool is one of the most common complaints from our owners and guests.


PARKING – Parking is assigned by unit.  All vehicles must display a Parking Pass and use only their assigned spot.  Vehicles not displaying a Parking Pass will be towed at owner’s expense.  Island Winds reserves the right to limit the number of Guests and/or Guest parking passes at any time during your stay due to occupancy concerns and available parking spaces.  Due to Covid-19, no extra parking passes will be issued for guests.


GUESTS OF RENTERS – Due to Covid-19, no unregistered guests of renters are allowed.  No overnight guests are permitted.  No guests are permitted on the common areas.


HOUSEKEEPING – You are staying in someone's home, not a hotel,  and as such there is no daily housekeeping.  Your agreement to stay presumes you are responsible for daily cleaning, and keeping laundry to a minimum at departure. The housekeeping staff will be responsible for the bed linens and towels used immediately before departure only. A departure instruction sheet will be provided.


  TERMINATION OF STAY – Island Winds is home to many full time residents and we have adopted policies for the enjoyment of all residents, renters and guests.  The willful disregard of these policies can result in immediate TERMINATION                                              OF STAY with NO REFUND of any unused portion of stay or security deposit.

·              No smoking of any substance is allowed in any unit, hallway, balcony, lanai, or main pool area. Smoking is allowed in the lower deck area or grill area.

·              No pets of any kind may be kept or brought on the premises.

·              Glass is prohibited in the pool area and lower pool area.

·              Fireworks may not be ignited on the beach from the middle of the beach to the buildings.

·              Grills, barbeques, fryers, or open fires of any kind are not allowed within 200 yards of Island Winds’ premises. Outdoor grills are provided.

·              Abuse of elevators by any guest, including unattended children, is not permitted.

·              Conduct considered by Island Winds to be raucous, profane or disturbing to other residents and  guests, or conduct that damages Island Winds’ property, will not be tolerated and can be grounds for immediate termination of your reservation.
